What Business Students Must Know Before They Use AI

Years ago, while judging a student competition, I encountered a phrase that stayed with me: Stress is to students what salary is to employees. The comparison sounds strange at first, but it captures something important. Education forces students to manage stress due to deadlines, expectations, criticism, uncertainty, and responsibilities within a relatively safe environment. Students learn to function when answers are difficult to find, deadlines are real, and their work may be questioned. That pressure helps them build skills their professional lives will later demand, such as discipline, resilience, prioritization, and judgment.
Generative AI has weakened the connection between pressure and performance. In the workplace, employers rarely care whether an employee used AI to prepare a client update, financial model, market analysis, or internal memo. They care whether the work is accurate, useful, and up to professional standards. The result almost always matters more than the struggle.
But shortcuts that circumvent struggle are valuable only when they shorten a journey the individual already knows how to complete. That’s the irony of the AI era: Students who benefit most from AI may be those who need it least. Students who can already write clearly may use AI to write faster, and those who can already analyze a case may use AI to test alternative interpretations. These students already know how to write, reason, question, verify, and revise; they recognize when an answer is shallow, when a source is weak, when an argument skips a step, or when a fluent paragraph hides a false assumption. They use AI to enhance their skills, not replace them.
But students who lack those underlying skills face the opposite risk—the tool that helps their peers think faster may allow them to bypass the skills that education is supposed to develop. Rather than amplify their competence, AI will conceal its absence.
Since we cannot realistically ban AI in our classrooms, our best response is to concentrate low-tech, high-accountability experiences at the beginning of each program. Such experiences could be delivered through a Human Intelligence Certificate module—a short, intensive curriculum that requires students to develop and demonstrate core analytical, writing, reasoning, and communication skills before unrestricted AI use becomes part of their coursework. And one of the most practical ways for business schools to deliver this module is to anchor it in a subject they already teach: law.
What Would the Certificate Look Like?
A Human Intelligence Certificate program could be delivered at the beginning of a program in face-to-face, online, or hybrid formats. Some instruction could occur asynchronously, but demonstrations of competence would require direct observation through supervised writing, live case discussions, oral examinations, or secure online assessment.
Ideally, every incoming business student would complete the certificate before enrolling in AI-intensive courses. Lasting two to four weeks, the program would help students establish a baseline of competence and train them to recognize that AI should amplify their competence, not serve as a substitute for it.
Some schools already recognize the value of similar bridge experiences. My own institution, Wenzhou-Kean University in China, operates a Pre-University Intensive English Program that helps incoming Chinese students adjust to studying, communicating, and functioning in an English-language academic environment. In the same way, a Human Intelligence Certificate would be a bridge to reasoning, analysis, argumentation, judgment, and independent thought.
Common-law reasoning helps students discover that sympathy is not evidence, confidence is not proof, and arguments that seem persuasive must still be defended.
Why base such a program on law? Legal education provides a toolkit for teaching these skills through structured analysis, close reading, audience-aware writing, adversarial argument, research discipline, public-policy reasoning, and live questioning.
In traditional business law courses, students learn to understand contracts, liability, employment rules, intellectual property, compliance, or legal risk. This certificate program would train students to think and defend judgment in environments where information is abundant, answers are cheap, and consequences are real.
In other words, they would be introduced to the disciplined method of common-law reasoning.
Students would initially work inside a closed universe of materials, reasoning carefully based strictly on the information available. They would begin with facts, identify the issues, locate governing authorities, apply rules, distinguish competing precedents, and defend conclusions that may remain uncertain. When facing problems that might feel unfair, urgent, or morally obvious, students would learn to test potential solutions against evidence and competing interpretations. The goal would be for them to discover that sympathy is not evidence, confidence is not proof, and arguments that seem persuasive must still be defended.
Why Legal Reasoning Suits Business
In the age of AI, it is more important for managers to possess critical thinking skills, because they increasingly must evaluate machine-generated answers, test claims, recognize weak reasoning, and explain decisions under close scrutiny and tight deadlines.
Common-law reasoning offers several advantages for business education:
- It is a tested, teachable, and assessable method for certifying that students can think independently. It trains students to separate facts from assumptions, evidence from assertions, and emotional reactions from analytical judgment.
- It exists in a living system, and the world constantly supplies new material. Every week brings new regulatory actions, controversies, and court decisions that can be turned into teachable problems. Students can read excerpts from actual opinions, compare competing arguments, identify rules, apply those rules to new facts, and ask whether the outcomes make sense.
- It cultivates elegant writing. Some of the most elegant and precise public writing is found in court decisions. At its best, legal writing arranges messy facts, competing values, imperfect rules, human emotions, and unresolved disagreement into arguments that can be examined, challenged, and defended. It is a form of disciplined imagination.
- It emphasizes precision under pressure. This is especially true in criminal statutes, where every word matters. Because deprivation of liberty or life and public condemnation may follow, the law demands proof beyond a reasonable doubt. A single word or phrase can suggest whether conduct is lawful or criminal. In a Human Intelligence Certificate program, students would learn to ask what each word is intended to communicate and whether evidence is strong enough to support the conclusion. They would come to recognize that words are not decoration; they allocate responsibility.
After students learn to apply existing law to facts, they can be pushed one step further: Should the rule be changed? Does it produce fair results? Does it create the right incentives? Can it be administered in practice? What are the unintended consequences? This is where legal reasoning becomes public-policy reasoning. Students learn to move from “What is the rule?” to “What should the rule be?” They must consider competing interests, institutional limits, social costs, economic effects, fairness, predictability, and enforcement.
That habit is deeply relevant to managers who do not merely follow rules. They help design policies, shape organizational culture, respond to regulations, and make decisions that affect employees, consumers, markets, and communities.
Legal Reasoning Supports Purposeful Learning
Business educators can borrow two additional tools from legal education: moot court and mock trial. Moot court emphasizes doctrine, precedent, policy, and appellate questioning; mock trial emphasizes evidence, witness credibility, factual narrative, and persuasion. Both force students to reason under pressure and defend their conclusions when the script breaks.
Perhaps the most powerful tool legal education offers is the Socratic method. In its classic form, students are called on in class and asked a sequence of questions that require them to explain, defend, and refine their understanding in real time. Used carelessly, the Socratic method can be intimidating or unnecessarily punitive; but when used thoughtfully, it compels students to listen carefully and take responsibility for their reasoning.
Traditional legal education also gives students practical tools for organizing thought. The legal concept of FIRAC analysis—often summarized as facts, issue, rule, application, and conclusion—is sometimes criticized for being formulaic when taught without nuance. But at its best, it gives students a disciplined sequence for moving from information to judgment: What happened? What is the question? What rule applies? How does that rule interact with these facts? What conclusion follows?
One Course, One ‘Master Case’
In practice, a Human Intelligence Certificate program could be built around one continuing “master case” rather than a series of disconnected exercises. For example, students might begin with a supervising attorney’s memorandum and a fixed factual record, much like a junior associate receiving a new client matter.
Faculty could provide relevant authorities and precedents, creating a closed universe in which students must identify the facts, isolate the issues, brief the cases, and prepare an objective internal memorandum predicting the likely outcome. Students would then discuss their analysis with classmates, defend their reasoning, and revise their conclusions.

As the course develops, the same material could be transformed for different professional audiences: It could become a client advice letter, a negotiation position, a persuasive court filing, and eventually an oral argument or mock hearing. Later, faculty could open the universe to include guided legal research, requiring students to locate additional authority, evaluate credibility, and decide whether new information changes the analysis or is simply beside the point.
Smaller assignments could build individual skills; the master case would show students how all the elements of common-law reasoning connect across the full arc of professional judgment.
Essential Preparation for AI-Integrated Work
Successful completion of this program could be recognized through a certificate or transcript notation that signals to employers that students know how to analyze and communicate information without relying on AI—that they can work under pressure to deliver reliable outcomes.
Students who earn the certificate would be permitted and encouraged to use AI as part of later coursework, research, writing, analysis, and professional preparation. Those who do not yet meet the standard would receive targeted instruction, engage in additional practice, and have further opportunities to develop their skills.
Business schools could deliver a Human Intelligence Certificate internally, partner with law faculty where available, or create a cross-disciplinary module drawing on existing institutional expertise. They would need to set out clear standards and transparent expectations, offer support and training to students and faculty, and provide students with opportunities to retake the module or complete additional practice. Online and hybrid programs would need to incorporate secure assessment methods and live demonstrations of reasoning.
But as AI becomes a mainstream professional tool, adding such a program is becoming more essential. After all, the next competitive advantage for business schools likely will not be graduating students who can use AI. It will be graduating students who can think, reason, and communicate without it.
